You should carefully read the following Warlord Dissent Terms of Service Agreement (The "Terms of Service" OR "Agreement"). Your participation in Warlords Dissent is regarded as affirmation with the terms of service and binds you in an agreement to abide by the stated terms of service.
Welcome to Seven Gaming Limited (The "Company") and Warlords Dissent (The "Game"). The Game includes material specifically made for the Company use (Collectively, the "Game Art") and Warlords Dissent online service (The "Service"). Your use of the Service is subject to the Agreement, incorporated herein by this reference.
1) To use the Service:
Subject to your Agreement to and continuing abidance with the Agreement, you may use the Service strictly for your own non-commercial entertainment purposes. You may not use the Service for any other purpose, or in connection with any other software irrespective of origin. Account sharing, meaning the use of an account by many users, is not permitted. Every user agrees to use only one user account per game world (unless otherwise approved by the administration).
2) Limitations:
You agree that you will not, under any circumstances:
A. Use automation software (bots), hacks or any other unauthorised third-party software contrived to alter the Warlords Dissent experience;
B. Exploit the Game and any part of it, including without limitation the Service, for any commercial purpose, for gathering in-game credits or resources for sale outside the Game or performing ingame services in exchange for payment beyond the Game environment;
C. Create, use, maintain or assist in the use of any unauthorised third-party software that may intercept or otherwise collect information through the Game or Service;
D. Create, maintain or assist in the creation of multiple accounts (Multies) (except by the explicit approval of the administration). If an account is traced back to you, by the Agreement, your account will be terminated and, if applicable, any legal costs will be debited to your account for any disruption of the Service; or
E. Disrupt or aid in the disruption of (a) any computer(s) used in conjunction or to support the Service; or (b) any other player's Game experience;
F. You agree that you will not violate any applicable laws or regulation in connection with your use of the Game / Service. Any attempt by you to disrupt the Game / Service or undermine the lawful operation of the Game will be a violation of Criminal and Civil laws.
3) Eligibility:
You represent that you are an adult in your country of residence. You agree to the Agreement on your own behalf and, if applicable, for one (1) minor child for whom you are the parent or guardian and whom you have authorised to use the account created on the Service. Eligibility does not constitute any ownership, which is covered in the next section.
4) Ownership:
All rights and titles in and to the Game / Service are owned by the Company. All resources, titles, medals are the intellectual property of the Company. The Game / Service are protected by United Kingdom, European and international laws.
5) Establishing an Account:
Prior to creating a user account on the Service (a "WD Account"), or using an existing WD Account, you may be required to establish a separate account (a "Sevens Account") on the Company's centralised account system. When creating these accounts, you agree that you will supply accurate information to the Company when requested, and that you will update that information promptly after it changes. Your information, which will range from but is not limited to, personal information, financial information and additional WD Account information will not be shared with any third party.
6) Username and Password:
During the registration process, you will be required to select a unique username and a password (collectively referred to hereunder as "Login Information"). You may not share the Account or the Login Information with anyone, unless you are the parent or guardian of one (1) minor child whom the Account was created for, other than as set forth herein.
7) No Ownership Rights in or to the Account:
You acknowledge and agree that you have no ownership or other interest in the Account, and you further acknowledge and agree that all rights in and to the Account are and shall forever be owned by the Company.
8) Account Suspension or Termination:
The Company may temporarily or permanently suspend, modify or terminate your Account at any time for any reason or for no reason, with or without notice to you.
9) Code of Conduct:
Your use of the Game / Service is governed by certain rules which the Company has compiled. These rules (the "Code of Conduct"), maintained and enforced by the Company, must be adhered to by all users of the Game / Service. The Company reserve the right to determine which conduct it considers to be outside the spirit of the Game and to take such disciplinary measures as it sees fit up to and including termination of the Account.
A. Rules Related to Usernames and Kingdom Designation.
Each user will select a unique name for their Account and "Settlements" / "Tribes/Kingdoms" (Collectively called "kingdoms"). When choosing a name for the kingdom and any other aspect of the Game where a label will be viewable by other users, the user must abide by some simple guidelines and the laws of common decency. If you are found to be going against the guidelines of the Company or the laws of common decency, the Company will at its absolute discretion, take disciplinary action. In particular, you may not use any name:
A. Belonging to another user with the intent to impersonate that person;
B. That contains vulgar language or which is otherwise denigratory, hateful, obscene, offensive, or racially, ethnically or otherwise objectionable;
C. That belongs to a popular culture figure or celebrity;
D. Belonging to any religious figure or deity;
E. Related to drugs, sex, alcohol, or criminal activity;
F. Comprised of partial or complete sentence (e.g., "eatmyfoot", "Wehateu", etc);
G. You may not use a misspelling or an alternative spelling to circumvent the name restrictions listed above, nor can you have a "First" and "Last" name that, when combined, violate the above name restrictions.
B. Rules Related to "Chat" and Interaction With Other Users.
Communication will occur in the form of text and is an integral part of the Game and the Service. This is referred to as "Chat". Chat, when dealing with the Game, the Service, the Company and other users, must be to the guidelines of the Company which are as followed:
A. You may not transmit or post any content or language which is deemed to be offensive (including without limitation content or language that is abusive, denigratory, harassing, harmful, hateful, threatening, obscene, sexually explicit, unlawful, vulgar, or racially, ethnically or otherwise objectionable) nor may you use a misspelling or an alternative spelling to circumvent the content and language restrictions (listed above);
B. Carry out any action with a disruptive effect, such as intentionally causing a scroll bar with large amounts of text that, when used, can have a disruptive effect on the normal flow of Chat;
C. Disrupt the normal flow of dialogue in Chat or otherwise act in a manner that negatively affects other users including without limitation posting commercial messages, advertisements for goods and services available outside of the Game environment;
D. Communicate or post any user's personal information in the Game, or on websites or forums related to the Game;
C. Rules Related to Game Play:
Game play is what Warlords Dissent is all about, and the Company strictly enforces the rules that govern game play. The Company considers most conduct to be part of the Game, and not harassment, so when another user attacks you for resources repeatedly we see it as part of the Game. The Company can intervene at any time at its sole discretion. Nonetheless, there are certain acts that go beyond what the Company considers fair and a serious violation of the Agreement. Those acts include, but are not limited to:
A. Using or exploiting errors in design, features which have not been documented, and/or program bugs to gain access to, that is otherwise not available, or to obtain an advantage over other players.
10) Security and Login Information:
You are responsible for the maintaining and confidentiality of the Login Information. You may not share the Login Information with anyone, unless you are the parent or guardian of one (1) minor child. If you suspect your Login Information has been compromised, then change it and contact the Warlord Dissent Team by emailing support@warlordsdissent.com
The Company does not accept any responsibility for the loss, changing or otherwise of your Login Information. You are solely responsible for the security of your Login Information. Sharing of Login Information is a breach of the Agreement and will result in termination of your Account.
11) Ownership/Selling of the Account or Virtual Items:
The Game does not recognize the transfer of WD Accounts or Sevens Accounts (each an "Account"). Accounts can not be purchased, sold, gifted or traded, and you can not offer to purchase, sell, gift or trade any Account, and any such attempt shall be a breach of the Agreement. The Company owns, has licensed, or otherwise has rights to all of the content that appears in the Game. You agree that you have no right/title in or to any such content, including without limitation the virtual goods, or any other attributes associated with the Account or stored on the Service.
12) Changes to the Agreement or the Game:
The Company reserves the right to modify any of the Agreement at any time, including without limitation, the availability of the Service, features of the Game / Service, hours of availability, content, data required to access the Game / Service, effective without prior notice. The Company will provide you with notification of any such changes by email or ingame notices. If any future changes to the Agreement are unacceptable, or if you are no longer in compliance with the Agreement, you must immediately terminate your Account and stop using the Service. Should you continue to play the Game following any modification to the Agreement, you accept all changes completely and irrevocably. The Company has the full right to modify or discontinue any aspect of the Game at any time. The Company may also impose restrictions and limitations on certain features or parts of the Game without notice or liability.
13) Termination:
This Agreement is effective until terminated. You may terminate this Agreement by terminating the Account. The Company may terminate the Agreement with or without notice by terminating the Account as set forth in Section 8. The provisos of Sections 4, 7, 11 and 14-17 shall survive any termination of this Agreement.
14) Warranty Disclaimer:
The Game / Service are provided "as is" and the Company does not warrant that the Game / Service will be uninterrupted or is error-free, that defects will be corrected, or that the Game / Service are free of viruses or other harmful components.
15) Limitation of Liability:
The company shall not be liable in any way for damage or loss of any kind resulting from (a) the use of, or the inability to use, the Game / Service included but not limited to work stoppage, computer failure or malfunction; (b) the loss or damage to accounts, information or statistics; or (c) interruptions of service, software or hardware failures or any other event which may lead to a loss of data or disruption of service.
16) Acknowledgments:
You hereby acknowledge and agree that:
A. When accessing the Game / Service, the Game may monitor your CPU or RAM for unauthorized third party programs running concurrently with the game. Upon detection of any third party software found to be in breach of this Agreement and the Agreement's Sections 1, 2 and 9, the user Account, of the third party software, will be terminated.
B. When accessing the Game / Service, the Company may obtain certain identification information about your computer, O/S, hard drives, IP address(es), MAC address(es) for purposes of improving the Service and to police and help enforce the Agreement.
C. The Company may, with or without notice to you, disclose your IP address(es) and personal information in response to a request by law enforcement or to any legal proceedings.
D. The Company may monitor, record or review your chat session without notice to you, and you hereby consent to such monitoring, recording, review and disclosure. You also acknowledge that the Company is under no obligation to monitor Chat. You enter chat at your own risk.
E. The Company/Game may contact you via email and/or send you periodic newsletters or announcements relating to the Game.=
F. You are completely responsible for the cost/damages of all servicing, repair, maintenance in connectivity to the Game / Service.
G. You will not use copyrighted material for settlement avatars and Tribe/Kingdom banners. Should you do so, you are completely responsible for the cost/damages of all copyright infringements for settlement avatars and Tribe/Kingdom banners.
17) Miscellaneous:
If any part of the Agreement is unlawful or for any reason unenforceable, then that part shall not be applicable to this Agreement and shall not affect the validity and enforceability of any other part of the Agreement. The Agreement is the complete and exclusive statement of the Agreement between you and the Company concerning the Game / Service. The Section headings used herein are for reference only and have no legal effect.
